$684k Awarded To Crash Victim After Botched Brake Job

A Nevada state court jury smacked the largest franchiser of tire retailers in North America, Big O Tires LLC, with a $684,000 verdict on Thursday, after the company admitted to performing a faulty brake job that caused a serious car accident.

Jurors deliberated for less than a day following a four-day trial before awarding plaintiff Kathleen Morrell what her attorney Paul Marrero of Golightly & Vannah claims is an amount over 10 times larger than Big O’s highest settlement offer of $60,000. The company admitted liability midway through the trial, according to Marrero, so the jury only deliberated over the amount of damages Morrell’s alleged injuries justified after she was rear-ended in 2013 by a car serviced at Big O.

High Profile Personal Injury Cases

Personal injury cases provide those injured with access to the justice system in a non-criminal manner. The goal of such a lawsuit is to compensate a victim for their injuries or provide some other remedy. Remedies can be a variety of things from reimbursement of medical expenses to compensation for loss of future earnings. The severity and length of the injury will typically determine the type of remedy. Personal injury cases typically hinge on proving cause, meaning that the defendant caused the injury sustained. While the idea of a personal injury case may seem foreign, there have been several high profile personal injury cases in recent history.

The OJ Simpson Civil Trial- though he was found not guilty of criminal charges, he lost the civil case that only required proof via a preponderance of the evidence. The jury determined that there was enough evidence to hold Simpson liable.

Conrad Murray the doctor who was convicted of involuntary manslaughter in the death of Michael Jackson was also at the center of a personal injury case when Michael Jackson’s family sued AEG, the concert promoter that had hired Dr. Murray.

Another well known personal injury case was the subject of a book that was later turned into a movie starring John Travolta. A Civil Action revolved around a case in Woburn, MA where the drinking water had been contaminated resulting in several cases of leukemia.

You may have also heard of the injuries that have plagued the Broadway production of Spider-Man. One of theperformers has sued producers for reimbursement of medical expenses for the injuries he sustained during a stunt on the show.

A current example of a personal injury case is the lawsuit that comedian Tracy Morgan filed against Wal-Mart for injuries he sustained when one of Wal-Mart’s trucks crashed into his limo.

As you can see personal injury law can cover any number of injuries, situations, and remedies.

Why You Should Hire a Personal Injury Attorney

Before an individual hires a personal injury attorney to handle their claim, it is important to know what types of cases that they are responsible for handling. Since this is an attorney that specializes in a specific area of law, there are some clients that they may be referred to other lawyers, specifically because it is not their area of expertise. This said, it is important to understand what they do and the reasons why it is best to contact them with a claim.

Reason #1 – Fairer Settlements

Sometimes people are not prepared to go through a long drawn out complicated trial when an injury is sustained in car accident or other situations. So, they may prefer to settle the case out of court so that they can move on. In these situations, people will get the best results when they hire their owner personal injury to follow the settlement process all the way thru. One of the main reasons is these lawyers are not only familiar with law, but also the amount that is really fair for the person to be awarded.

Reason #2 Best Results with a Jury Trial

In some cases, the injury that was sustained in a slip and fall accident or an automobile accident may be more severe. Therefore, the person will need to be compensated for their medical bills, time off the job and for any pain and suffering caused. Which means, they need an experienced personal injury to win the case if it goes to trial. These attorneys can also fight for the best compensation amount so that the person does not end up paying their medical bills out of pocket.

Reason #3 – Well Versed in this area of the Law

Another important reason for hiring a personal injury lawyer is to draw on their many years of experience with these kinds of cases. Which means, the cases can be handled more expeditiously when they are familiar with all of the litigation that is involved.

Reason #4 – Interprets and Handles Complicated legal procedures

Filing a personal injury claim against an individual is not always as simple as most people may think. The laws that govern this area are normally complicated because of the legal and medical terms involved. With an experienced attorney on staff, these clients can be walked more efficiently and thoroughly through this legislative process.

There are many different reasons why a personal injury attorney should be contacted. Four of the most common involve receiving better settlement awards, getting the best results in a jury trial, obtaining seasoned advice from an experienced attorney and hiring a professional to interpret and respond to complicated medical and legal terms.

Top Five Most Common Personal Injuries

Personal injury is a broad term that is used to describe an injury that results from another person’s negligence. There are thousands of personal injury claims filed each year. However, some are far more common than others. Below are some of the most common personal injury claims:

Road Traffic Accident

Car accidents are on the rise in the United States. One of the reasons that car accidents are on the rise is because many drivers are distracted while they are driving. Texting or talking on the phone while driving, putting on makeup and eating are just a few of the many ways that drivers can get distracted while they are driving. Drunk driving, speeding and reckless driving are some of the other things that can contribute to road traffic accidents.

Even though many people are fortunate to walk away from a car accident with no injuries, others are left with serious injuries. Additionally, some people are unable to work for a long time after they get into an accident. That is why many people file a personal injury claim after a road traffic accident.

Work-Related Injuries

Every day, hundreds of employees in the United States are injured while they are on the job. Employers are responsible for keeping workplace hazards to a minimum. If a person is injured on the job due to employer negligence, then he or she may be able to file a personal injury claim.

It is estimated that there were two million simple assault cases in 2010. Many people choose to file a personal injury lawsuit in addition to criminal charges. Personal injury lawsuits may also include a claim for emotional distress.

Slip and Fall Accidents

It is estimated that 20,000 people in America died due to a slip and fall injury. Slip and fall accident can happen anywhere, including the supermarket, workplace or at home. Older people are at a greater risk for suffering a slip and fall accident. In order for a person to prove a slip and fall claim, one must prove that the employee or owner must have known about the dangerous conditions. One must also be able to prove that the owner or employee knew about the danger but did not do anything to fix it.

Product Liability

Manufacturers are required to test their product in order to make sure that it is safe before it hits the market. If a person suffers an injury due to a product defect, then the company could be held liable.
